Terms and Conditions

GENERAL TERMS AND CONDITIONS OF SALE

1. Introduction

The website www.dixystore.com (hereinafter referred to as the “Site”) is owned by Zaira Giulianelli, registered office at Via Torricelli 7, 60019 Senigallia (AN), Italy – VAT No. 02812990428.

Through the Site, the Seller offers for sale the products displayed on the Site (hereinafter the “Product” or “Products”).

These General Terms and Conditions of Sale (“General Conditions”) govern the remote purchase of Products through the Site in accordance with Italian law.

Customers accessing the Site to make purchases (“Customer”) are required to carefully read and accept these General Conditions before placing an order.

Sales through the Site are reserved exclusively for consumers pursuant to Article 3 of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005), meaning “a natural person acting for purposes unrelated to any business, commercial, artisanal, or professional activity carried out.”

The Customer must be at least 18 years old.


2. Product Selection and Orders

The main characteristics of the Products (variants, quantities, colors, etc.), together with specific information (composition, materials, allergens, etc.) and pricing, are indicated within each Product description page.

Product images are intended solely to present the Products for sale and may not perfectly represent every characteristic of the Product. However, product labels faithfully correspond to the selected Product.

Customers may purchase either as a “Registered User” or as a “Guest.”

To complete a purchase, the Customer must submit the electronic order form and select a payment method.

After submitting the Order:

  • The Customer will receive a confirmation email containing the order number, list of Products, and total price (including shipping costs).

  • The Seller will verify product availability. In cases of total or partial unavailability, or incorrect customer information, the order may be cancelled or only partially fulfilled.


3. Prices and Shipping Costs

All Product prices are expressed in Euros and include VAT where applicable.

Shipping costs, when applicable, are charged to the Customer and are clearly indicated before the Order is submitted.


4. Payment Methods

Customers may pay using the following methods:

Credit or Debit Card

Visa, MasterCard, American Express, Maestro.

The Site does not store credit card details.

PayPal and Digital Wallets

Apple Pay, Google Pay, and other payment methods accepted through PayPal or Shopify Payments.


5. Legal Warranty and Limitations of Liability

The Seller provides the legal warranty of conformity required under the Italian Consumer Code.

This warranty is strictly limited to manufacturing defects or intrinsic material defects existing at the time of delivery and not detectable at the time of purchase.

Explicit Exclusions

In order to ensure maximum transparency and prevent improper warranty claims, the following are expressly excluded from warranty coverage:

Damage Caused by Animal Interaction

Any signs of biting, chewing, tearing, or scratching caused by the animal’s teeth or claws.

Such damage is technically incompatible with manufacturing defects.

Accidental Damage and Negligence

Breakage, cracks, or malfunctions of components (such as buckles or clips) caused by:

  • Falls onto hard surfaces (asphalt, concrete, etc.)

  • Crushing

  • Impact damage

  • Doors or car doors closing on the product

  • Other accidental impacts

Improper or Non-Compliant Use

Damage resulting from use of the Product for purposes other than those intended or with animals exceeding the technical size or strength limits specified in the product description.

Wear and External Factors

Natural fading of colors, wear caused by daily friction, improper washing, or exposure to corrosive substances.

Warranty Claim Procedure

In the event of a presumed defect, the Customer must send detailed photographic documentation via email to: info@dixystore.com

This documentation must include close-up images of the damaged area.

The Seller reserves the right to subject the Product to technical inspection. If signs of abnormal pulling, impact, chewing, or misuse are identified, the warranty claim will be rejected.


6. Errors and Limitations of Liability

Product information is constantly updated; however, the Seller cannot guarantee the complete absence of errors.

The Seller reserves the right to correct errors or inaccuracies even after an Order has been submitted.

Except in cases of intentional misconduct or gross negligence, the Seller excludes any right of the Customer to compensation for direct or indirect damages to persons and/or property arising from the rejection, including partial rejection, of an Order.


7. Complaints

8. Intellectual Property

The Customer acknowledges that all trademarks, names, distinctive signs, images, photographs, written texts, and graphic materials used on the Site or relating to the Products are and remain the exclusive property of Zaira Giulianelli and/or their respective owners.

Access to the Site and the purchase of Products do not grant the Customer any rights over such materials.

Any reproduction, whether total or partial, of Site content is prohibited without the prior written consent of Zaira Giulianelli.


9. Personal Data Processing

Customer data is processed by the Seller in compliance with applicable data protection legislation (GDPR), as specified in the Privacy Policy available in the dedicated section of the Site.
